Cross-Jurisdictional Analysis as Sent to the Attorney General: November 10, 2023
A comprehensive, comparative view of Prompt Payment Legislation across Canadian jurisdictions presented to British Columbia’s Ministry of the Attorney General, Minister of Finance, and the Premier. Developed proactively by the BCCA in response to a letter from the Attorney General’s office this past summer that a thorough cross-jurisdictional analysis would be required before moving forward on prompt payment policy development.
BCCA continues to sound the alarm: British Columbia lags behind most other Canadian jurisdictions in its failure to enact key and necessary legislation for BC’s construction industry. In an effort to accelerate consideration of Prompt Payment Legislation, Lien Reform, and Adjudication, BCCA has submitted a complete cross-jurisdictional analysis to the BC Government. Prepared by Weirfoulds LLP, it clearly demonstrates just how far behind the province currently is when it comes to this commonsense legislation. At a time when Government is enacting other measures aimed at alleviating the housing and workforce crises, BCCA is confident that legislators will understand the urgency of passing Prompt Payment Legislation quickly, in the next legislative cycle. BCCA and its industry partners will continue to advocate for legislative change as the best way forward for BC’s construction industry, the economy and the people of British Columbia.
